Vibehen Terms of Service

1. Acceptance of Terms

Welcome to Vibehen (hereinafter referred to as the "Platform"). By accessing, browsing, or using the Vibehen website, application, services, and related content, you indicate that you have read, understood, and agreed to be bound by these Terms of Service (hereinafter referred to as the "Terms"). If you do not agree with any part of these Terms, please immediately cease using the Platform.

2. Description of Services

We reserve the right to modify, suspend, or terminate any part or all of the services at any time without prior notice.

3. User Account

You must provide true, accurate, and complete registration information and update it promptly.
Impersonating others or misappropriating another person's account is prohibited.
You are responsible for all activities under your account and must keep your account password strictly confidential.
Vibehen reserves the right to temporarily or permanently suspend or terminate an account if it suspects security risks or violations of these Terms.

4. User Conduct

You agree not to engage in the following conduct while using Vibehen:

Posting or transmitting illegal, obscene, violent, defamatory, harassing, discriminatory, fraudulent, or other unlawful content
Infringing upon others' intellectual property rights, portrait rights, privacy rights, or other legitimate rights and interests
Using any automated programs, scripts, crawlers, or other abnormal means to access or interfere with the Platform
Engaging in unauthorized commercial advertising, spam marketing, private transactions, or similar activities
Any other conduct that violates the laws and regulations applicable in Hong Kong or the Platform's rules

5. Intellectual Property

All content on the Vibehen Platform (including but not limited to text, images, videos, audio, interface design, program code, etc.) is owned by Vibehen or the relevant rights holders.
Content uploaded by users remains owned by the users or original rights holders, but users grant Vibehen a worldwide, royalty-free, irrevocable, non-exclusive, sublicensable license to display, promote, store, reproduce, and modify (only to the extent necessary for format conversion, technical adaptation, etc.) such content.

6. Disclaimer

Vibehen assumes no responsibility for the truthfulness, legality, or accuracy of content posted by users.
The Platform is provided on an "as is" basis, without any express or implied warranties, including but not limited to merchantability or fitness for a particular purpose.
Vibehen shall not be liable for service interruptions or data loss caused by force majeure, hacker attacks, system failures, telecommunications disruptions, or other causes not attributable to Vibehen's intentional or gross negligence.

7. Limitation of Liability

To the fullest extent permitted by law, Vibehen and its affiliates, employees, and directors shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including but not limited to loss of profits, data loss, emotional distress, etc.) arising from or in connection with the use of the Platform, even if advised of the possibility of such damages.

8. Amendments and Termination

Vibehen reserves the right to amend these Terms at any time. The amended Terms will take effect upon posting on the Platform or notification to users. Continued use of the Platform constitutes acceptance of the amended Terms.
In the event of serious breach of these Terms, Vibehen reserves the right to immediately terminate the provision of services to you and to pursue legal remedies.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or in connection with these Terms or your use of the Platform shall be submitted to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
